Waiver of Liability and Release Agreement

 

I, the participant, acknowledge and agree to the following terms and conditions in favor of Embody Health and Fitness, its owners, employees, agents, coaches, contractors, and affiliates:

 

I understand and assume all risks associated with fitness programs, exercise activities, personal training, and nutrition counseling, including but not limited to physical injury, muscle strains, heart conditions, illness, and, in extreme cases, disability or death.

 

I waive and release all liability of Embody Health and Fitness, its owners, employees, agents, contractors, and affiliates from any claims, demands, liabilities, damages, or causes of action that may arise due to my participation, including but not limited to:

• Exercise programs, personal training, group fitness classes, or physical activity;

• Use of equipment, facilities, or provided workout routines;

• Any dietary or nutrition guidance, recommendations, or consultations provided.

 

I acknowledge that Embody Health and Fitness is not a medical provider. Any fitness or nutrition advice provided is for informational purposes only and should not be considered medical advice. I am responsible for consulting a healthcare professional before making any changes to my diet, exercise, or wellness routines.

 

I agree to indemnify and hold harmless Embody Health and Fitness from any claims, liabilities, costs, or expenses, including attorney fees, arising from my participation in activities or reliance on information provided.

 

I confirm that I:

• Have read and understand this Agreement;

• Am voluntarily participating at my own risk;

• Understand that I am waiving legal rights, including the right to sue;

• Am physically capable of participating or have consulted a medical professional before engaging in any fitness or nutrition programs.

 

I agree that this Agreement is governed by the laws of the state in which Embody Health and Fitness operates, and if any part of this Agreement is found to be invalid or unenforceable, the rest shall remain in full force and effect.
